Legal Compliance & Regulatory Information. This page outlines the legal framework governing Eanhon Packaging‘s business operations, including applicable laws, regulatory compliance, and legal responsibilities for international B2B transactions. By engaging with our services, you acknowledge compliance with these legal standards.

Governing Law & Jurisdiction

All contracts, transactions, and disputes involving Eanhon Packaging are governed by the laws of the People’s Republic of China. In case of international trade disputes, the following protocols apply:

  • •Primary Jurisdiction: Courts of Shenzhen, Guangdong Province, China
  • •Arbitration: China International Economic and Trade Arbitration Commission (CIETAC) for cross-border disputes
  • •International Compliance: Transactions adhere to INCOTERMS 2020 and applicable international trade conventions

Import/Export Compliance

As an international manufacturer and exporter, we comply with:

  • China Customs Regulations: All exports comply with PRC Customs Law and commodity inspection requirements
  • Export Documentation: Commercial invoices, packing lists, certificates of origin, and required export licenses provided in accordance with destination country requirements
  • Trade Restrictions: We do not engage in trade with entities subject to UN, US, EU, or other applicable sanctions lists
  • Client Responsibilities: Importers are responsible for obtaining necessary import permits, paying customs duties, and ensuring compliance with local regulations in destination countries (Germany, France, USA, etc.)

Important: Customs duties, VAT/GST, and import taxes are the sole responsibility of the buyer. Eanhon Packaging is not liable for customs clearance delays or import restrictions in destination countries.

Product Safety & Environmental Standards

Our packaging products are manufactured in compliance with international safety and environmental regulations:

  • REACH Compliance (EU): Materials used comply with EU Regulation 1907/2006 regarding chemical substance restrictions
  • RoHS Directive: Electronic packaging components (if applicable) comply with restriction of hazardous substances standards
  • FSC Certification: Paper and wood-based materials sourced from FSC-certified suppliers upon request
  • Prop 65 (California): Products shipped to California comply with Safe Drinking Water and Toxic Enforcement Act warning requirements where applicable
  • Material Safety: All raw materials undergo testing to ensure they are free from toxic substances prohibited in jewelry and cosmetic packaging

Intellectual Property & Trademark Law

Intellectual property rights are strictly protected under Chinese law and international conventions:

  • Client IP Protection: All designs, molds, and specifications provided by clients remain their exclusive property. We execute strict confidentiality agreements and non-disclosure protocols.
  • Trademark Warranty: By providing logos and brand materials, clients warrant they own or are licensed to use all intellectual property. We assume no liability for trademark infringement arising from client-provided designs.
  • Design Originality: Our in-house designs remain our property unless explicitly purchased or licensed. Customizations based on client concepts become client property upon full payment.
  • Enforcement: IP violations will be pursued under the PRC Intellectual Property Law and applicable international IP treaties.

Legal Notice: Unauthorized reproduction of our product designs, website content, or technical documentation constitutes copyright infringement under PRC Law and international copyright conventions.

Data Protection & Privacy Compliance

We process personal data in compliance with:

  • PRC Personal Information Protection Law (PIPL): Chinese domestic data protection standards
  • •GDPR Compliance: For EU customers, we adhere to General Data Protection Regulation requirements for data processing and cross-border transfers
  • Data Security: 256-bit SSL encryption, restricted access controls, and secure server infrastructure protect your business information
  • Retention Policy: Business records retained for 7 years per Chinese tax law requirements, then securely destroyed

Limitation of Liability & Force Majeure

Limitation of Liability: Eanhon Packaging’s liability is limited to the value of the specific order or contract in question. We are not liable for indirect, consequential, or punitive damages, including lost profits, business interruption, or reputational harm.

Force Majeure: We are not responsible for delays or failures in performance resulting from events beyond our reasonable control, including but not limited to:

  • Natural disasters, epidemics, pandemics (COVID-19 and variants)
  • Government actions, trade embargoes, import/export restrictions
  • Labor disputes, strikes, or material shortages beyond our control
  • Shipping carrier delays, port congestion, or customs delays

Dispute Resolution Procedures

In the event of a dispute, the following escalation process applies:

  1. Negotiation: Good faith negotiation between parties for 30 days
  2. Mediation: If unresolved, non-binding mediation through Shenzhen Chamber of International Commerce
  3. Arbitration: Binding arbitration through CIETAC (China International Economic and Trade Arbitration Commission) in Shenzhen, conducted in English or Chinese
  4. Litigation: If arbitration is not elected, exclusive jurisdiction lies with Shenzhen Intermediate People’s Court

Anti-Corruption & Ethics Compliance

Eanhon Packaging maintains a zero-tolerance policy regarding corruption and unethical business practices:

  • Compliance with PRC Anti-Unfair Competition Law and international anti-bribery standards (FCPA, UK Bribery Act)
  • No facilitation payments or kickbacks solicited or accepted
  • Fair labor practices in accordance with Chinese Labor Law and international labor standards
  • Conflict minerals policy: We do not source materials from conflict zones or sanctioned regions
